New Federal Overtime Rules

On August 23, 2004, the Department of Labor implemented new rules and regulations for the Fair Labor Standards Act (FLSA). The FLSA is used for determining what positions are subject to time-keeping and overtime pay rules ("nonexempt") and what positions are exempt from such reporting and compensation requirements. We anticipate that the new rules and regulations governing duties and responsibilities will have an impact on several staff positions on campus. Those most greatly impacted will be the ones that have been traditionally designated as exempt, but will be reviewed for nonexempt status due to the changes to the FLSA.

Georgia State University is participating in a Board of Regents project, in consultation with an outside attorney who is expert in labor relations issues, to review job titles that are commonly used by institutions throughout the state. In addition to the positions reviewed at the University System level, Georgia State University’s Classification and Compensation Office will conduct a review of positions unique to our institution. We anticipate drawing on the expertise of the same attorney engaged by the Board of Regents to assist and advise in this review.

The Classification and Compensation Office will work closely through your representatives on the Human Resources Advisory Committee (HRAC) at every stage of the project to ensure that information is communicated at all levels. Each month the Classification and Compensation Office will sponsor events (e.g., lunch & learn sessions, training workshops and a webcast) on the FLSA for various members of the community. Events for the month of October are identified below. Details of future programs will be given to your Human Resources Advisory Committee representative for distribution throughout your college/division.
